Road traffic accident claims across Spain: Barcelona, Ibiza and Cádiz

From our offices in Barcelona, Ibiza and El Puerto de Santa María (Cádiz), we handle road traffic accident claims throughout these regions and across the whole of Spain.

This includes cases involving foreign nationals who were visiting or living here at the time of the accident: we can continue to represent you, in person or remotely, even after you have returned to your home country.

Know your rights and get the compensation you are owed

We are a firm specialising in road traffic accident claims — cars, motorcycles, bicycles, scooters and collective transport — with more than twenty years of experience and offices in Barcelona, Ibiza and Cádiz, from which we defend accident victims throughout Spain.

If you have been involved in a road traffic accident caused by someone else, you may be entitled to compensation for your injuries and for the personal and financial harm the accident has caused you.

Spain's compulsory motor insurance system allows you to claim against the insurer of the vehicle at fault. There are also specific mechanisms for particular situations, such as uninsured or unidentified vehicles.

But correctly assessing compensation takes far more than counting the days since the accident. The injuries, after-effects, moral harm, expenses, financial losses and, in serious cases, the future consequences of the accident all need to be properly valued. That is why it is important to study the accident and all of its consequences before accepting any offer from the insurer.

How is compensation for a road traffic accident calculated?

Compensation for the accident must cover all the personal, moral and financial harm the accident has caused you, and will continue to cause you in the future. It is calculated following the official Spanish compensation scale (baremo de circulación), currently set out in Law 35/2015, of 22 September, reforming the system for assessing damage to people in road traffic accidents — a text of more than 550 pages that only a specialist lawyer can properly interpret in your interest.

Compensation must cover:

Temporary injuries

The amount corresponding to the days you were unable to work, carry out household tasks or your usual leisure activities. The daily rate depends on the associated moral harm and the effect on your quality of life.

After-effects (sequelae)

This compensates for the physical, anatomical, functional, sensory or aesthetic harm that remains once you are medically discharged. Its value is set out in official tables, based on points assigned to the after-effect and your age.

Moral harm associated with after-effects

This compensates for how much those after-effects affect your personal or working life. Its value falls between a set minimum and maximum.

Financial harm

The costs the accident has caused you, and will continue to cause you (travel, home help, therapies, prosthetics, home adaptation, etc.), known as consequential damage (daño emergente). It also includes the loss of earnings caused by a partial, total or absolute incapacity, known as loss of profit (lucro cesante), the value of which depends on your annual income before the accident and your age.

2. Compensation in the event of death

This compensation is paid to the family members or close relatives the law recognises as affected parties: the spouse, ascendants, descendants, siblings, and other close relatives — meaning people who lived with the deceased for the five years before the accident, provided there was a bond of friendship or family.

The compensation consists of:

Basic personal harm

A fixed amount, which varies depending on whether the affected party is the spouse, an ascendant, a descendant, a sibling or another close relative.

Specific personal harm

A fixed amount, or a percentage increase on the above amount, in specific situations the law considers to cause greater harm — for example, when the affected party also has a disability, or when the deceased was the only surviving parent.

Financial harm

The costs the death causes to the affected parties (travel, accommodation and similar expenses), and the loss of income, provided the affected parties can show they depended financially on the victim. The spouse and minor children receive this amount without needing to prove financial dependency; children up to the age of 30 are presumed to be financially dependent, while other affected parties and children over 30 must prove financial dependency. The amount is set out in official tables, based on the deceased's income and the age of the affected party.

The more serious an accident is, the easier it is to freeze up. But it is important to stay calm and be aware of everything happening around you, and to recall exactly what happened, trying to establish as clearly as possible what, in your view, caused the accident.

Call an ambulance if you cannot move, or go to a hospital's accident and emergency department as soon as possible so your physical condition can be assessed. Make sure the medical report records that your visit was due to a road traffic accident, along with all the injuries resulting from it. You should request and keep the medical reports from every visit you make, including a final rehabilitation report.

Report the accident to your insurer as soon as possible and give them all the information you have. They will normally handle the repair of your vehicle, unless they consider it a total write-off — meaning the cost of repair is higher than the value of the vehicle. In that case, they will offer you an amount for the vehicle, which is often well below its market value. Our advice is not to accept that amount. They may also offer to handle your claim and negotiate compensation with the other insurer. Our advice is not to accept that offer either.

You need to instruct a lawyer you know, with certainty, specialises in road traffic accidents, to advise you and defend your interests. Do not choose just any lawyer your circle happens to know, or your accountant.

Look for a lawyer who specialises in road traffic accident compensation claims and who does not work for your insurer, or for any other insurer, since their judgement tends to be shaped by insurers' own restrictive criteria, which can create a conflict with the defence of your case.

Your policy usually includes a legal expenses allowance that will reimburse some or all of the cost of an independent specialist lawyer of your choosing.

Maximum compensation for road traffic accidents: proven experience

We fight every day to make insurance companies pay our road traffic accident clients the maximum compensation they are owed. Insurers' own protocols tend to be restrictive when assessing damage: they are businesses, and the less they pay out, the better their financial results.

We like to think that our work as lawyers with proven experience in road traffic accidents serves your interests, because we are committed to obtaining the maximum compensation possible, together with any public benefits you may be entitled to.

We are very selective about the road traffic accident cases we take on, because we never charge anything upfront — we only get paid if you do.

Tell us what happened, and we will review your case

Some testimonials from road traffic accident clients

«You have to let her do her job and not lose patience. She is always there when and where she needs to be.

It was a serious motorcycle accident. The insurer didn't want to pay anything. They offered €11,000. They claimed my injuries were degenerative and pre-existing, hired private investigators, and argued that what I had was invented. At the first trial, the judge ruled against them on part of the damages, but not on the full amount. Irene advised me to carry on and appeal the ruling, and we won almost everything, although a small part remained, which she also advised me to keep fighting for. The case is currently before the Supreme Court. The fact that she only charges a percentage of the compensation has helped me fight for what was rightfully mine. The insurer has already paid out more than €135,000 in compensation.

Irene Vieira is a very professional and honest lawyer, absolutely recommendable. I am deeply grateful to her, and I always recommend her.»

Gustavo Pastor VillullasMotorcycle accident, Ibiza

«My insurer wouldn't take responsibility for the accident. Irene looked into the case and secured a good settlement for me, with complete professionalism.»

Tribalik MusicCar accident, Ibiza

«Irene showed great respect and warmth towards the family at every stage. Thank you for the care with which you helped us through something so difficult.»

Frequently asked questions about road traffic accident compensation

How do I know if I am entitled to compensation for a road traffic accident?

If you have suffered harm as a result of an accident for which a third party is wholly or partly responsible, you may be entitled to claim compensation. It is necessary to study how the accident happened, the liability of those involved, and the personal and financial harm suffered.

Is Vieira Fuentes Abogados a specialist road traffic accident law firm?

Yes. We are a law firm specialising in road traffic accident claims and other personal injury cases, with offices in Barcelona, Ibiza and El Puerto de Santa María (Cádiz). We also help clients, including foreign nationals, who have had a road traffic accident anywhere else in Spain, in person or remotely.

What is a road traffic accident claim?

A road traffic accident claim is a legal process to obtain compensation for the injuries and losses caused by a collision on the road — as a driver, passenger, motorcyclist, cyclist or pedestrian — when someone else is wholly or partly to blame. It usually involves a claim against the insurer of the vehicle at fault.

How long does a road traffic accident claim take?

It depends on the severity of the injuries, whether liability is disputed, and whether the case can be settled with the insurer or needs to go to court. Straightforward claims can settle in a matter of months; more serious or disputed cases can take considerably longer. We give you a realistic timeframe once we have reviewed your case.

How is compensation for a road traffic accident calculated?

Spain's official compensation scale for road traffic accidents is applied, taking into account, among other things, recovery time, after-effects, aesthetic harm, certain surgical procedures, loss of quality of life and financial losses. The assessment must be carried out individually.

How long do I have to claim for a road traffic accident?

There are time limits for bringing claims arising from an accident, and how they are calculated can depend on the circumstances of the case and how the injuries progress. It is therefore advisable to establish the applicable time limit from the outset, rather than waiting for the insurer to consider the claim closed.

How much compensation can I claim for a road traffic accident?

There is no fixed amount: compensation depends on the injuries, after-effects, recovery time and financial losses, assessed under Spain's official compensation scale for road traffic accidents. We can give you a realistic estimate once we have reviewed your case.

Can I choose a different lawyer from the one my insurer offers?

Yes. You can choose an independent lawyer to represent your interests. In addition, many policies include legal expenses cover, which can reimburse some or all of the fees of the lawyer chosen by the policyholder, within the limits and conditions of the policy.

What can I claim for, besides my injuries?

Depending on the case, you may be able to claim for after-effects, moral harm, certain expenses, loss of earnings and other financial losses, as well as material damage arising from the accident.

What happens if the vehicle at fault has no insurance or leaves the scene?

Certain accidents caused by uninsured or unidentified vehicles, or in other situations set out by law, may give rise to a claim against Spain's Consorcio de Compensación de Seguros (Insurance Compensation Consortium). The specific circumstances of the accident need to be examined.

How much does a lawyer charge to claim for a road traffic accident?

Fees depend on the firm and the case. At Vieira Fuentes Abogados, we are selective about the cases we take on, and our success fee is tied to the outcome: we only get paid if the client does. We also check whether the policy includes legal expenses cover that allows some or all of the fees to be recovered.

Am I entitled to compensation for a road traffic accident if it happened in Spain but I am a foreign national?

Yes. Spanish law does not require Spanish nationality or residency to bring a road traffic accident claim. If the accident happened in Spain — whether you were visiting, working or living here — you are entitled to the same compensation as a Spanish national, regardless of your nationality or where you live now.

Do you have experience with road traffic accident claims involving foreign clients?

Yes. We have represented foreign clients in road traffic accident claims on numerous occasions, including cases where the client had already returned to their home country by the time the claim was resolved. We keep in touch by phone, video call and email throughout the case.
